KUALA LUMPUR, 7 Dis (Bernama) -- Kes bekas Perdana Menteri Datuk Seri Najib Tun Razak dan bekas Ketua Setiausaha Perbendaharaan Tan Sri Mohd Irwan Serigar Abdullah yang didakwa atas enam tuduhan pecah amanah melibatkan wang milik kerajaan Malaysia berjumlah RM6.6 bilion dipindahkan ke Mahkamah Tinggi.

Pesuruhjaya Kehakiman Datuk Rozana Ali Yusof membuat keputusan itu selepas membenarkan permohonan peguam Tan Sri Mohamed Shafee Abdullah yang bertindak bagi pihak Najib dan peguam Datuk K.Kumaraendran yang mewakili Mohd Irwan Serigar, bagaimanapun tarikh sebutan akan ditetapkan kemudian.

Terdahulu pada sebutan kes itu hari ini, Mohamed Shafee memberitahu mahkamah dua kes yang membabitkan bekas Perdana Menteri itu sudahpun dipindahkan ke Mahkamah Tinggi.

Mohamed Shafee berkata pemindahan kes itu dibuat di bawah Seksyen 417 Kanun Prosedur Jenayah, untuk mempercepatkan proses keadilan.

Selain itu, Kumaraendran mengguna pakai alasan yang sama dengan Muhamed Shafee bagi permohonan berkenaan, manakala pihak pendakwaan yang diketuai Timbalan Pendakwa Raya Datuk Jamil Aripin tidak mengemukakan sebarang bantahan terhadap permohonan berkenaan.

Sementara itu, ketika kes berkenaan disebut di Mahkamah Sesyen, Timbalan Pendakwa Raya Mohd Farez Rahman memohon tarikh sebutan baharu bagi memaklumkan kepada mahkamah itu berhubung keputusan memindahkan kes ke Mahkamah Tinggi.

“Hari ini ditetapkan untuk sebutan bagi pendengaran notis usul memindahkan kes ini ke Mahkamah Tinggi di hadapan Pesuruhjaya Kehakiman Rozana, arahan kami terima adalah untuk memohon tarikh sebutan seterusnya dua minggu dari sekarang,” kata Mohd Farez.

Tiada sebarang bantahan dikemukakan barisan pembelaan yang mewakili kedua-dua tertuduh.

Hakim Azman Ahmad kemudian menetapkan 18 Dis untuk sebutan semula kes di Mahkamah Sesyen.

Pada 25 Okt lepas, Najib, 65, dan Mohd Irwan Serigar, 61, mengaku tidak bersalah atas enam tuduhan pecah amanah, bagi pertuduhan pertama, mereka didakwa bersama-sama sebagai seorang penjawat awam iaitu Menteri Kewangan dan Ketua Setiausaha Perbendaharaan, Kementerian Kewangan Malaysia masing-masing dalam kapasiti itu telah diamanahkan dengan penguasaan ke atas harta itu iaitu sejumlah RM1.2 billion milik kerajaan Malaysia telah melakukan pecah amanah jenayah ke atas harta berkenaan.

Mengikut pertuduhan kedua, Najib dan Mohd Irwan Serigar didakwa bersama-sama atas jawatan sama yang telah diamanahkan dengan harta sejumlah RM655 juta milik Kerajaan Malaysia, telah melakukan pecah amanah jenayah ke atas harta berkenaan.

Bagi pertuduhan ketiga mereka didakwa bersama-sama atas jawatan serupa melakukan pecah amanah iaitu sejumlah RM220 juta, peruntukan di bawah “Belanja Mengurus di bawah Maksud B11 Perkhidmatan Am Perbendaharaan, Aktiviti 021700 KL International Airport Berhad (KLIAB)”, milik Kerajaan Malaysia.

Kedua-dua tertuduh juga didakwa bersama-sama atas jawatan sama telah melakukan pecah amanah sejumlah RM1.3 bilion, peruntukan di bawah “Maksud B11 Perkhidmatan Am Perbendaharaan, Aktiviti 020500 Subsidi Dan Bantuan Tunai”, milik Kerajaan Malaysia.

Bagi pertuduhan kelima dan keenam, mereka  didakwa bersama-sama atas jawatan serupa melakukan pecah amanah  sejumlah CNY1,950,000,000 (bernilai RM1,261,065,000) dan RM2 bilion milik Kerajaan Malaysia.

Najib dan Mohd Irwan Serigar dituduh melakukan kesemua kesalahan itu di Kompleks Kementerian Kewangan Malaysia,Wilayah Persekutuan Putrajaya pada 21 Dis 2016 bagi pertuduhan pertama dan kedua, pada  3 Ogos 2017 pertuduhan ketiga manakala pertuduhan keempat hingga keenam pada 10 Ogos 2017, 23 Ogos 2017 dan 18 Dis 2017 .

Mereka didakwa mengikut seksyen 409 Kanun Keseksaan dibaca bersama seksyen 34 Kanun yang sama yang memperuntukkan hukuman penjara maksimum 20 tahun dan sebatan dan boleh dikenakan denda, jika sabit kesalahan.
